What Happens if I’m Convicted of an OWI/DUI Offense in Michigan?
If you are convicted of an OWI/DUI offense in Michigan, the penalties associated with that conviction have the potential to be very serious. To be sure, a first time OWI offense is penalized by jail time of up to 93 days in jail, as well as up to 360 hours of community service. A first time DUI conviction also is penalized with a driver’s license suspension, license restriction, and up to a $1,000 fine. If you are convicted of a DUI/OWI a second time, these penalties increase to up to one year in jail, and a minimum of one year driver’s license revocation.
If you are pulled over for drunk driving and asked to submit to a breathalyzer test, refusing the test may stop your BAC from being discovered temporarily, but has serious consequences under the implied consent laws if you are convicted later. While you are legally allowed to refuse to submit to testing, doing so has it’s own set of penalties. Always keep in mind that you have the right against self-incrimination, and taking roadside tests does not require you to do more than a set of static test questions, physical acts, and/or blow into a breathalyzer. It is not advisable to disclose how many drinks you have had or any other information.
