When Should You Get a Personal Protection Order in Michigan?

Everyone deserves to feel safe in their home and community. Unfortunately, volatile relationships, stalking or harassment can shatter that sense of security and put you or your family at serious risk. If you are constantly looking over your shoulder or living in fear of someone else’s actions, legal tools are available to help restore your peace of mind. At Van Den Heuvel Law Office, we understand the urgency of these situations and provide the tenacious representation needed to secure legal protection quickly. Consider seeking a personal protection order if you’re experiencing any of the following situations:

  • When you are being harassed, stalked or threatened and fear for your safety.
  • If you are experiencing violence or the credible threat of violence from another individual.
  • When someone’s actions are disrupting your ability to feel safe at home, work or in public.
  • If a volatile relationship has escalated to behavior that causes emotional or physical distress.
  • When there is a clear need to prevent further contact or communication from a specific person to protect your well-being.

Am I Eligible for a Personal Protection Order?

In Michigan, a Personal Protection Order (PPO) is a court order intended to stop threats or violence against you. Generally, you should consider filing for a PPO if you have a reasonable fear for your personal liberty or safety. You do not always need to wait for physical violence to occur; threats, harassment, and stalking are valid grounds for seeking protection.

To obtain an order, you must file a petition with the court explaining what the individual has done to harm you or make you afraid. While police reports are helpful evidence, they are not strictly required to file the petition.

Which Type of PPO Fits My Situation?

Michigan law recognizes that threats come from different sources. Therefore, the courts offer three specific types of PPOs. Choosing the correct one is vital for your petition’s success.

  • Domestic Relationship PPO: This is for situations involving a current or ex-spouse, someone you have a child with, a current or former roommate or someone you have dated romantically. You must show the judge that this person is likely to assault, threaten, harass or stalk you.
  • Nondomestic (Stalking) PPO: This protects you from someone with whom you have no domestic relationship. To qualify, you generally must show at least two separate incidents of harassment or unwanted contact that causes you emotional distress and serves no valid purpose.
  • Nondomestic Sexual Assault PPO: This is designed to defend you from a person who has sexually assaulted you or threatened to do so, provided you do not have a domestic relationship with them.

How Do I File for a PPO in Michigan?

To start the process, you must file a petition with the court. If you are in immediate danger, you can request an ex parte order. If granted, this means the judge signs the order without holding a hearing first, and the abuser will not know about the PPO until after it is served. This is often the safest route for victims who fear retaliation.

If the judge does not grant an emergency ex parte order, or if you do not request one, the court will schedule a hearing. In this scenario, the abuser must be served with papers and has the right to attend the hearing to defend themselves.

What Happens If a Hearing Is Required?

If your case goes to a hearing, both you and the respondent (the person you are filing against) will appear before a judge. This can be an intimidating process. You will need to present evidence and may need to call witnesses to prove why the order is necessary.

Because you must follow the Michigan Rules of Evidence and court procedures, representing yourself during a contested hearing is difficult. Having an experienced attorney by your side ensures your voice is heard and your evidence is presented correctly.
